Age

I have been employed by my local video shop since I was 15. I have regularly worked more than 20 hours per week. I have just turned 18, and have been told that that my hours will be reduced to only ten hours because there isn't enough work for me to do. At the same time they have employed another 15 year old. I think it is because they have to pay me more now that I have turned 18. Can they do this?

This situation could be age discrimination. Employers can pay junior wages if they are part of an award. However, reducing hours or conditions simply because you are older and have to be paid more could be unlawful.


My employer is a large manufacturer. They have announced that they will be downsizing and offering voluntary separation packages. They have told us that all our accumulated sick leave will be included in the package if we are 45 or older, while those under 45 miss out. I think this is unfair, but is it age discrimination?

If the terms and conditions of worker's employment differ on the basis of age this may be age discrimination, unless your industrial award or agreement allows for this.
