What discrimination is against the law?
Is all discrimination and harassment against the law?
Under South Australia's Equal Opportunity Act, only certain types of discirmination based on personal characteristics is against the law. These personal characteristics include disability, race, age, sex, sexuality, pregnancy and marital status. Sexual harassment is also unlawful.
However, many forms of discrimination are not covered. For example, mental illness, religion and caring responsibilities are not covered by South Australian law, but are covered federally and in all other Australian states and territories.
A Bill to update equal opportunity laws in South Australia is currently before Parliament. If passed, it would bring SA into line with discrimination protections available interstate.
